[inaudible] our problem is the oil spill equipment and the technology has never been tested here in the arctic in real-life situations due to the rules of the united states. because there has never been any real exercise here in the arctic involving broken ice conditions and the recovery of oil. it is the burning that is being mentioned, the technology being used in warmer waters, it has never been done up here and that continues to be our concern. it is difficult to take the words of industry and agencies just that their words. that is the overriding condition. the least-sale provisions i mentioned earlier continue to be the focus for the lower 48 waters. the time frame f

with the 9th u.s. circuit court of appeals in san francisco but it appears only the prison can actually -- if the 9th circuit u.s. court doesn't grant -- [ inaudible ] >> reporter: -- only then. the condemned man is albert green woofed brown. he was sentenced to death in 1982 for the rape and murder of a 15-year-old riverside, california, girl. this morning attorneys speaking for brown will ask a marin superior court to stay the execution. they say changes to the lethal injection protocol are minor and that the judge that allowed it to go forward doesn't respond correctly or allow public commentment yesterday he missed a deadline to choose between a one drug execution and a three drug execution. >> the judge's ruling today really gives albert brown a hobson's choice, which is no choice at all. judge fogel is saying albert brown must either give up his rights under the federal constitution or his rights under state law. it is completely unfair. >> the 9th circuit court of appeal will look at several of the issues including the judge's ruling itself. the judge, who said there are several

the car hit her and then took off. matt aklin joins us live. >> reporter: we took the family members off the camera who had just visited her in the hospital. they say she did not look good. doctors are not sure if she will recover. 24-year-old daniela was born in guatemala. most recently she lived and worked about a block from where she was hit around 8:00 saturday night. she was struck a few feet away from her boyfriend's home. >> i heard a thump. it sounded like a car hit another car. >> montgomery county police are doing all they can to find the driver of what they believe was a small dark sedan, possibly a honda. they say the force of the impact caused some damage and even a piece of evidence was left behind. >> it did leave the right-hand side exterior passenger mirror on the scene after it struck her. >> neighbors say this narrow stretch of carol avenue can be hazardous. many drivers ignore the speed limit we're told even with the school just across the street. >> i've seen a crossing guard almost get hit trying to cross the kids to school. so people don't go by the speed limit. >>

, the calendar says summer is over but mother nature seems to be ignoring it. our anne makovec joins us now from walnut creek to explain that pg&e is urging conservation this morning. good morning, anne. >> reporter: good morning. here in downtown walnut creek, it is hanging around the lower 60s. you can see from this live time and temperature behind me. it's going to get up to 102 here in walnut creek. that creates two issues. number one, it's a "spare the air" day and the possibility of power outages so many people are running their air- conditioning it could lead to overload. that's what happened in castro valley this weekend. more than 30,000 pg&e customers lost power for almost three hours on saturday night. pg&e says it was a heat-related equipment failure issue. the mere thought of not having ac can have us sweating. but this may make things easier on the power grid. shut your windows and keep blinds closed in the morning, right now, to keep cool air trapped in the home. try to remember to turn off lights and appliances either right now or before the sun comes up. do your best to use them
